If you are a good fit for our green card for top talent solution, you will need to complete our agreement by e-signature and make the initial payment. You will engage the independent attorney of your choice through a separate agreement.
Onboarding call

The initial phase of your immigration journey begins with a comprehensive onboarding call with our team. During this call, we will provide a detailed walkthrough of the entire process, ensuring you have a clear understanding of each step involved. Our priority is to simplify the process and guide you seamlessly through each phase, ensuring your application is complete and well-prepared.
Document and information gathering, including intake forms

After the onboarding call, you will start gathering the necessary documents, completing intake forms, and submitting them through our secure platform.
Strategy call with independent attorney
Scheduled within 3-5 business days
Our team will collaborate with you to choose the attorney that best matches your specific needs and preferences. During the call, you, our client manager, and the independent attorney will review the strategy to create a winning case!
Ultimately, the independent attorney you choose to work with is your decision. The attorney will then send you a separate agreement for their representation. Within 48 hours, the client manager will send you a welcome kit with customized next steps and a timeline for your case.
Prepare USCIS petition with attorney and Visa Franchise’s assistance
4-8 weeks to complete
Our team will initiate the collection of necessary documents and review your CV if needed. We will develop your business/personal plan based on your proposed endeavor. Please be sure to allocate 3-4 hours to thoroughly complete the business and professional plan questionnaire. It's essential to dedicate this time, as these questionnaires are a crucial part of our process.
For entrepreneur clients, we provide support by opening a U.S. company, obtaining a relevant tax ID, registering the beneficial ownership information (BOI) with FinCEN, and setting up the corporate bank account. Additionally, we assist with professional association membership alignment and collaborate with PR agencies to vet and source publications for you.
Simultaneously, our team will support your chosen immigration attorney in preparing an array of documents, including but not limited to Form I-140, your petition letter, business/personal plan, letters of recommendation, and any documentation demonstrating that a labor certification would adversely affect the U.S. national interest, among others.
Petition approved, denied, or requested for further evidence (RFE)
2–8 months to receive the final decision on the petition
Depending on your case, your petition might be approved in about six months (as of July 2024). If you decide to file for premium processing, which requires a $2,805 fee, it can take up to 45 days. However, please note that filing for premium processing increases the likelihood of receiving a Request for Evidence (RFE). An RFE should not be confused with a denial or rejection; it simply means additional information is needed, and you will be given a timeframe within which to provide the requested evidence.
Wait for the priority date to be current
0-15 years (depending on visa bulletin and country of birth)
The priority date is marked as the day the USCIS receives your I-140 petition. Be sure to check the monthly visa bulletin released by the Department of State to see if your priority date matches the final action date given in the EB-2 category for your country of birth.
Adjust status or apply at a U.S. consulate
6-12 months
Once your Final Action Date is current, you can either adjust your status if you are in the U.S. under a valid nonimmigrant status, or you can go through consular processing. The median wait time for the I-485 is 9 months (July 2024). Consular processing involves making an appointment with a U.S. Consulate or Embassy in your home country and participating in a one-on-one interview with a consular officer. The average wait time is currently 3 to 4 weeks and for this reason, Visa Franchise recommends you start working on this process as soon as possible. You are not able to open a corporate bank account without an EIN.
